Indian River County restaurant inspections: 7 eateries make ‘most violations’ list

Florida’s restaurant owners are not required to post restaurant inspection results where guests can see them. So every few weeks, we provide that information for you.

Each inspection report is a “snapshot” of conditions present at the time of the inspection. On any given day, an establishment may have fewer or more violations than noted in its most recent inspection. An inspection conducted on any given day may not be representative of the overall, long-term conditions at the establishment.

In the last few weeks, 50 eateries passed inspection at the first visit. Two restaurants did not pass the first inspection. One eatery had zero violations. There were no shutdowns.

Most violations in the last 30 days

Mo-Bspany Grill, 1401 Indian River Drive, Sebastian. Cited for 38 violations. They include: accumulation of debris inside ware washing machine; bathroom located inside establishment not completely enclosed with tight-fitting, self-closing doors; bucket of margarine stored on floor in the walk in cooler; bucket of bag soda on the floor in the dry storage area; clean utensils , cups, bowls, plates, pots and pans not stored inverted or in a protected manner; cold holding equipment not maintained in good repair; drain cover(s) missing; employee chewing gum while preparing food or while in a food prep; employee wearing jewelry other than a plain ring on their hands/arms while preparing food;  employee with no beard guard/restraint while engaging in food preparation; floor area(s) covered with standing water;  in-use ice scoop stored on soiled surface between uses; in-use utensil stored in standing water less than 135 degrees Fahrenheit. 128 F; light shield damaged/in disrepair; old labels stuck to food containers after cleaning; shelves in prep area soiled; single-service articles not stored inverted or protected from contamination; 10 foot-candles of light at least 30 inches from floor not provided in walk-in cooler; unnecessary items/unused equipment on the premises;  water pouring out of AC unit causing water to lay on the floor; wet mop not stored in a manner to allow the mop to dry; wiping cloth ammonium compound sanitizing solution not at proper minimum strength; wiping cloth sanitizing solution stored on the floor; cooked/heated time/temperature control for safety food not cooled from 135 degrees Fahrenheit to 41 degrees Fahrenheit within 6 hours; dish machine chlorine sanitizer not at proper minimum strength; employee failed to wash hands before putting on gloves to initiate a task working with food; raw animal food stored over or with unwashed produce in the walk in cooler; raw steaks over cooked foods in the walk in cooler; stop sale issued on time/temperature control for safety food due to temperature abuse; time/ temperature control for safety food cold held at greater than 41 degrees Fahrenheit; vacuum breaker missing at mop sink faucet or on fitting/splitter added to mop sink faucet; employee has not received adequate training related to their assigned duties as evidenced by lack of general knowledge in performing their assigned duties; food being cooled by non-approved method as evidenced by inadequate rate of cooling during time of inspection; hand wash sink used for purposes other than hand washing;  ice machine, can opener and microwave soiled; no currently certified food service manager on duty with four or more employees engaged in food preparation/handling; paper towel dispenser at hand wash sink not working/unable to dispense paper towels;  ready-to-eat, time/temperature control for safety food prepared onsite and held more than 24 hours not properly date marked; water pressure lacking at hand sink that require the use of water.

Mulligspann’s Bespanch House Bspanr spannd Grill, 1025 Beachland Blvd., Vero Beach. Cited for 18 violations. They include: bowl or other container with no handle used to dispense food; ceiling/ceiling tiles/vents soiled with accumulated food debris, grease, dust, or mold-like substance; cutting board has cut marks and is no longer cleanable;  employee personal items stored in or above a food preparation area, food, clean equipment and utensils, or single-service items; employee with no beard guard/restraint while engaging in food preparation; equipment and utensils not properly air-dried; floors not constructed to be easily cleanable; hole in or other damage to wall; lights in food preparation, food storage or ware washing area missing the proper shield, sleeve coatings or covers; 10 foot-candles of light at least 30 inches from floor not provided in walk-in freezer; waste line missing at soda gun holster;  working containers of food removed from original container not identified by common name; dish machine chlorine sanitizer not at proper minimum strength;  food-contact surfaces not sanitized after cleaning, before use; raw animal food stored over/not properly separated from ready-to-eat food; food-contact surface soiled with food debris, mold-like substance or slime;  and hand wash sink used for purposes other than hand washing.

The Lemon Tree, 3125 Ocean Drive, Vero Beach. Cited for 15 violations. They include: bathroom located inside establishment not completely enclosed with tight-fitting, self-closing doors; employee beverage container on a food preparation table or over/next to clean equipment/utensils; garbage can located outside has no lid or lid open/broken;  garbage on the ground and/or pad around dumpster; interior of oven has accumulation of black substance/grease/food debris;  non-food-contact surface soiled;  wet wiping cloth not stored in sanitizing solution between uses; employee touching ready-to-eat food with their bare hands; time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit;  vacuum breaker missing at hose bibb or on fitting/splitter added to hose bibb; hand wash sink removed from food preparation/dish washing area; manager or person in charge lacking proof of food manager certification; menu does not identify which items contain raw or undercooked animal foods covered by the consumer advisory; no paper towels or mechanical hand drying device provided at hand wash sink; and required employee training expired for some employees.

Blue Agspanve, 1979 14th Ave., Vero Beach. Cited for 14 violations. They include: accumulation of debris inside ware washing machine; bathroom located inside establishment not completely enclosed with tight-fitting, self-closing doors;  carbon dioxide/helium tanks not adequately secured; clean linens stored in improper location; current Hotel and Restaurant license not displayed; food stored on floor; no copy of latest inspection report available; standing water in bottom of reach-in-cooler; stored food not covered; food-contact surface soiled with food debris, mold-like substance or slime; hand wash sink used for purposes other than handwashing; no currently certified food service manager on duty with four or more employees engaged in food preparation/handling;  no paper towels or mechanical hand drying device provided at hand wash sink; and spray bottle containing toxic substance not labeled.

Portside Pub spannd Grill, 717 Coolidge St., Sebastian. Cited for 14 violations. They include: buildup of dust/grease/soil residue on hood filters; ceiling/ceiling tiles/vents soiled with accumulated food debris, grease, dust, or mold-like substance; clean utensils or equipment stored in dirty rack;  floor soiled/has accumulation of debris; in-use tongs stored on equipment door handle between uses; interior of microwave has accumulation of black substance/grease/food debris; nonfood-contact surface soiled with grease, food debris, dirt, slime or dust;  reach-in cooler interior/shelves have accumulation of soil residues; soiled cloths, linen, aprons, coats, or other uniform apparel not kept in a suitable container prior to laundering; stored food not covered;  Unnecessary items/unused equipment on the premises;  ready-to-eat, time/temperature control for safety food marked with a date that exceeds seven days after opening/preparation; no soap provided at hand wash sink; and proof of required state approved employee training not available for some employees. 

Squid Lips, 1660 N. Indian River Drive, Sebastian. Cited for 13 violations. They include: ceiling/ceiling tile shows damage or is in disrepair; floor soiled/has accumulation of debris; hole in or other damage to wall; soiled dry wiping cloth in use; working containers of food removed from original container not identified by common name; employee touched soiled apron/clothes and then handled clean equipment or utensils or touched unwrapped single-service items without washing hands; employee touching ready-to-eat food with their bare hands – food was not being heated as a sole ingredient to 145 degrees F or immediately added to other ingredients to be cooked/heated to the minimum required temperature to allow bare hand contact;  raw animal food stored over/not properly separated from ready-to-eat food;  time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit;  toxic substance/chemical improperly stored. Chemical at 3 compartment sink at bar; consumer advisory for raw or undercooked oysters not posted/provided in a conspicuous location; clam/mussel/oyster tags not marked with last date served; and food-contact surface soiled with food debris.

Countryside Fspanmily Fspanrms/El Sid Tspanquerispan, 3300 Ocean Drive, Vero Beach. Cited for 13 violations. They include: buildup of food debris/soil residue on equipment door handles; employee with no beard guard/restraint while engaging in food preparation; floor soiled/has accumulation of debris;  insect control device installed over food preparation area;  label on a food item prepared and packaged onsite for customer self-service does not include product identity/deion, date product was packaged and name and address of the establishment that prepared and packaged the food;  no copy of latest inspection report available; nonfood-contact surface soiled with grease; unnecessary items/unused equipment on the premises;  wall soiled with accumulated grease, food debris, and/or dust;   ammonium sanitizer not at proper minimum strength for manual ware washing; raw animal food stored over/not properly separated from ready-to-eat food; vacuum breaker missing at hose bibb or on fitting/splitter added to hose bibb; and hand wash sink not accessible for employee use at all times.

The three-tiered system includes high priority violations, which indicate a direct concern related to possible food-borne illness; intermediate violations, which reference an incident that could contribute to a food-borne illness if not corrected; and basic violations, which identify good retail practices.
