Florida’s restaurant owners are not required to post restaurant inspection results where guests can see them. So every few weeks, we provide that information for you.

Each inspection report is a “snapshot” of conditions present at the time of the inspection. On any given day, an establishment may have fewer or more violations than noted in its most recent inspection. An inspection conducted on any given day may not be representative of the overall, long-term conditions at the establishment.

In the last few weeks, 95 restaurants in Indian River County passed inspection on the first visit, but 23 did not. Two were temporarily shutdown and two had zero violations.

The Florida Department of Business and Professional Regulation’s Division of Hotels and Restaurants conducts unannounced inspections using a three-tier system for food safety and sanitation inspections.

Shut down restaurants

  • Burger King #1208, 1928 U.S. 1, Vero Beach; shut down Feb. 13 and reopened Feb. 14
  • Polo Grill, 2855 Ocean Drive, Vero Beach, shut down Feb. 9, still noncompliant after Feb. 11 reinspection; reopened Feb. 11

Most health violations in the last 30 days

  • Sespann Ryspann Pub, 2019 14th Ave., Vero Beach, had 14 violations including accumulation of black/green mold-like substance in the interior of the ice machine/bin; carbon dioxide/helium tanks not adequately secured; employee beverage container on a food preparation table or over/next to clean equipment/utensils; employee with no hair restraint while engaging in food preparation; equipment and utensils not properly air-dried – wet nesting; old labels stuck to food containers after cleaning; standing water in bottom of reach-in-cooler; working containers of food removed from original container not identified by common name; dish machine not sanitizing properly; employee touching ready-to-eat food with their bare hands – food was not being heated as a sole ingredient to 145 degrees F or immediately added to other ingredients to be cooked/heated to the minimum required temperature to allow bare hand contact; employee used cell phone then engaged in food preparation, handled clean equipment or utensils, or touched unwrapped single-service items without washing hands; food stored in ice used for drinks; hand wash sink not accessible for employee use at all times; and spray bottle containing toxic substance not labeled.

  • Nino’s Corner, 4236 20th St., Vero Beach, had 14 violations including accumulation of debris on exterior of ware washing machine; bathroom located inside establishment not completely enclosed with tight-fitting, self-closing doors; carbon dioxide/helium tanks not adequately secured; ceiling/ceiling tile shows damage or is in disrepair; clean glasses, cups, bowls, plates, pots and pans not stored inverted or in a protected manner; employee with no hair restraint while engaging in food preparation; raw fruits/vegetables not washed prior to preparation; wet wiping cloth not stored in sanitizing solution between uses; wood food-contact surface not properly sealed; live, small flying insects in kitchen, food preparation area, food storage area and/or bar area; server handled soiled dishes or utensils and then picked up plated food, served food, or prepared a beverage without washing hands; hand wash sink not accessible for employee use at all times; no chemical test kit provided when using sanitizer at three-compartment sink/ware washing machine or wiping cloths; and no proof of required state approved employee training provided for any employees.
  • Phspantz Chick N Shspanck, 1555 US 1, Ste. 104, Vero Beach, had 14 violations including accumulation of substance in the interior of the ice machine on white guard; ceiling/ceiling tiles/vents soiled with accumulated food debris, grease, dust, or mold-like substance; covered waste receptacle not provided in women’s bathroom; employee beverage container on a food preparation table or over/next to clean equipment/utensils; employee with no hair restraint while engaging in food preparation;  food stored on floor; light not functioning in hood; nonfood-contact surface soiled with grease, food debris, dirt, slime or dust; plumbing system in disrepair; single-service articles improperly stored; dish machine chlorine sanitizer not at proper minimum strength; commercially processed ready-to-eat, time/temperature control for safety food opened and held more than 24 hours not properly date marked after opening; and no currently certified food service manager on duty with four or more employees engaged in food preparation/handling.
  • Burger King #1208, 1928 US 1, Vero Beach, had 14 violations including a minimum of one bathroom facility is not available for public use; clean glasses, cups, bowls, plates, pots and pans not stored inverted or in a protected manner; floor and wall junctures not coved in food preparation/storage/ware washing areas or bathroom; floor not cleaned when the least amount of food is exposed; grease on the ground and/or pad around grease receptacle; nonfood-contact surface soiled with grease, food debris, dirt, slime or dust; open dumpster lid; plumbing system in disrepair; reach-in cooler interior/shelves have accumulation of soil residues;  unnecessary items/unused equipment on the premises; displayed food not properly protected from contamination; sewage/wastewater backing up through floor drains in both restrooms; manager or person in charge lacking proof of food manager certification; and no proof of required state approved employee training provided for any employees.

The three-tiered system includes high priority violations, which indicate a direct concern related to possible food-borne illness; intermediate violations, which reference an incident that could contribute to a food-borne illness if not corrected; and basic violations, which identify good retail practices.
